POLICY APPENDIX

By consenting to the User Agreement, you also agree to the additional terms and policies shown below (hereafter “Appendix”).


ADVERTISING AND LISTING GUIDELINES POLICY

A. Introduction
1. Before you advertise your item(s) and/or service(s), you need to determine whether it will be allowed on BubbaPages.com and if your item(s) or services(s) are subject to certain restrictions to avoid potential issues with your listing(s) or advertisement(s). As a Standard or Premium Advertiser (“Advertiser”), you are ultimately responsible for making sure that your product or service is lawful wherever it is sold.

2. The scope of this policy shall encompass all advertising on BubbaPages.com, whether in the form of a display ad, a listing, or some other method. The term “Advertisement,” for purposes of this Policy and the entire Appendix, shall refer to an individual instance of any such advertising.

3. Examples are used for illustrative purposes only. They are not intended to exhaustively state the underlying policy.

4. Violation of this policy may result in a range of actions, including:
a. Advertisement cancellation or removal
b. Temporary or permanent limits on account and/or advertising privileges
c. Suspension of advertising privileges
d. Account suspension, in whole or in part
e. Account termination, in whole or in part
f. Editing of the Advertisement to remove material that caused the violation, if it can be done without changing the actual content of the Advertisement as displayed to the User (for example, removing offending HTML or Javascript code)

5. BubbaPages.com is not designed to be a general forum for all Advertisements or subject matter. Therefore, remember that the Advertising and Fees Policy requires that the subject matter of your Advertisement relate, at least in a materially significant way, to Residential or Commercial Construction, Residential or Commercial Building Improvement or Repair (specifically to include Home Improvement or Repair), Home or Office Decoration, Structural Maintenance, Exterior Landscaping, or its related skills and/or trades (collectively, the “Allowed Subject Matter”). Advertisements not meeting this requirement may be suspended or removed, notwithstanding any other Policy or provision to the contrary.

6. Users may contact us of violations by using the “Contact Us” link, as available from the home page, or at other locations within the Site, or through other methods, as outlined in the User Agreement.

7. There are situations where we are compelled to remove an Advertisement immediately without prior notice to the Advertiser. These include, but are not limited to, in response to a lawful order from a government authority (for example, a court order), situations where the product or service is unlawful on its face, and/or where the continued posting of the advertisement poses a threat to the health or safety of others. In such cases, the Advertiser shall be advised of the removal and provided a reasonable opportunity to respond.

B. Prohibited and Restricted Subject Matter List
1. Directed to Mature Audiences:
a. Materials, products, or services, that are adult in nature or otherwise inappropriate for minors (individuals younger than eighteen (18) years of age) may not be listed or displayed on this site. This includes, but is not limited to, the sale or display of pornography, sexual aids or devices, drugs or stimulants advertised as “enhancements,” other drugs and related paraphernalia, weapons, tobacco products, and alcohol.
b. Profanity within an Advertisement is prohibited. An exception is available where profanity is an inherent part of the product’s name, but such matters shall be handled by us on a case-by-case basis.

2. Items or services that are illegal on its face are not allowed.

3. Items or services that are designed solely to enable illegal activity (for example, a book on how to manufacture a controlled substance, receive premium satellite television services without authorization, or employ an undocumented immigrant alien) are not allowed, even if the item or service was itself technically legal or somehow relates to the Allowed Subject Matter.

4. The listing and advertising of multi-level marketing programs, matrix, pyramid, Ponzi schemes, and all similar programs are not permitted, whether or not they are considered legal in one or more jurisdictions.

5. The listing of products previously identified by the Consumer Product Safety Commission as hazardous to consumers -- and thus subject to a recall -- are not permitted.

6. All other products or services: Must relate to the Allowed Subject Matter, is not intended or directed solely to Mature Audiences, and does not infringe on a trademark, copyright, or patent. If all of these are true, then advertisements for such products and services are permitted, but only to the extent allowed by law.

C. Misrepresentation in Advertisements or Situations involving Bad Faith
1. Unless an exception is noted, Advertisers cannot:
a. List products or services in inappropriate categories. (For example, an Advertisement for electrical work cannot be listed under a category that relates to plumbing, unless the service provider is capable of performing both services.)
b. Where listings are involved, have misleading titles that do not accurately describe the product or service.
c. Where banner or display Advertisements are involved, have misleading information or enticements, such that if the User were to click on the banner or other Advertisement, they would be taken to a website or web page that is unrelated to the original Advertisement or its subject matter. (For example, a user clicking on a banner ad for plumbing services should not be taken to an attorney’s website, unless said attorney is also licensed as a plumber and the website is substantially related to plumbing.)
d. Create Advertisements that do not offer a product or a service.


USER FEEDBACK POLICY

A. Provisions
1. If a User receives an Access Code for the purpose of rating any Advertiser, it must be used solely for the purpose of rating that Advertiser as to the goods and/or services provided to the User, and for no other purpose.

2. A User is not required to rate an Advertiser and cannot be compelled to do so, even if he or she was provided with an Access Code.

3. However, Users cannot threaten to withhold favorable feedback unless the Advertiser provides goods and/or services outside the scope of the User’s contract with said Advertiser, provides goods and/or services at a lower cost than was previously agreed, provides some other valuable consideration, or for similar reasons.

4. A User, by receiving an Access Code from an Advertiser, expressly agrees that it remains our property, and cannot be transferred or disclosed to others.

5. Violation of this policy may result in a range of actions, including:
a. Listing cancellation or removal
b. Temporary or permanent limits on account and/or advertising privileges
c. Suspension of advertising privileges
d. Account suspension, in whole or in part
e. Account termination, in whole or in part
f. Feedback removal
Additionally, Users could be held legally responsible for damages to an Advertiser’s reputation if a court were to find that the remarks constitute libel or defamation. Under federal law (the Communications Decency Act), because we do not censor feedback or investigate it for accuracy, we are not legally responsible for the remarks that Users post, even if those remarks are defamatory. However, this law does not protect the person who leaves the feedback from responsibility for it.


COMMUNITY CONTENT POLICY

A. Provisions
1. We may provide Registered Users (including all Advertisers who are also Registered Users) with one or more forums, including, but not limited to, Discussion or Message Boards, to enable them to provide factual information, solicit and receive opinions or guidance, and to publish other personal commentary or content to the Site. Messages published on such forums shall be considered “Community Content.”

2. Community Content published or edited by Registered Users is solely the opinion and responsibility of the person posting the content. All content posted to one of these forums must comply with all aspects of the User Agreement and this Policy.

3. Violation of this policy may result in a range of actions, including:
a. Listing cancellation or removal
b. Temporary or permanent limits on account and/or advertising privileges
c. Suspension of advertising privileges
d. Account suspension, in whole or in part
e. Account termination, in whole or in part
f. Content removal

4. The following examples are not intended to be exhaustive, but are listed to demonstrate the behaviors that Users shall avoid:
a. Placing published content in the wrong category (miscategorization).
b. Using another Registered User’s content without that User’s express permission.
c. Using intellectual property without the property owner’s express permission, where applicable.
d. Publishing more than one identical piece of content concurrently.
e. Encouraging, promoting, facilitating, or instructing others to engage in illegal activity or to violate any of our policies.
f. Enabling, encouraging, or instructing others to infringe copyrights, trademarks, or other intellectual property rights.
g. Promoting giveaways, lotteries, random drawings, raffles, or prizes of any kind.
h. Using HTML and JavaScript functions prohibited by us. For more information, please refer back to the User Agreement.
i. Using keywords, random links, inaccurate titles, text, or other content not directly relevant to the subject of the Community content for the purpose of gaining attention or diverting members to that content. This practice is sometimes known as “Keyword Spamming.”
j. Publishing content or images that are adult in nature, intended or directed at Mature Audiences, or otherwise not appropriate for minors (individuals under 18 years of age).
k. Linking to items, services, or content prohibited by us or to sites that offer items, services, or content prohibited by us.
l. Misrepresenting yourself as an employee of BubbaPages LLC or as another BubbaPages.com User and/or Advertiser.
m. Publishing personal contact information of any person in any public area of BubbaPages, including emails, phone numbers, name, street address, etc.
n. Misusing the violation reporting function in order to maliciously or frivolously report content as not in compliance with one or more of our policies.
